You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

3. Services

We provide digital memorial services including obituary pages, tribute content, and online burial brochures. We may modify or discontinue Services at any time without liability.

4. User Obligations

You agree to:

  • Comply with all applicable laws of the Federal Republic of Nigeria;
  • Provide accurate information;
  • Respect intellectual property rights;
  • Avoid submitting unlawful, defamatory, or offensive content.

5. Prohibited Conduct

You shall not:

  • Engage in fraudulent or unlawful activity;
  • Upload harmful code (viruses, malware);
  • Attempt unauthorized access to systems;
  • Interfere with platform security;
  • Use bots, scrapers, crawlers, or automated tools to extract data;
  • Copy, reproduce, or exploit platform content without permission.

6. User Content and Licence

By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute such content for the purpose of operating and promoting the Services.

You warrant that you have all necessary rights and consents, including from family members or individuals depicted.

7. Next-of-Kin Authorization

You confirm that you have obtained consent from the deceased's next-of-kin or authorized representatives. We reserve the right to suspend or remove content in case of disputes.

8. Content Accuracy Disclaimer

All memorial content is user-provided. We do not verify its accuracy and are not liable for errors or omissions.

9. Cultural and Religious Sensitivity

Users are responsible for ensuring submitted content aligns with applicable cultural and religious expectations.

10. Content Takedown Policy

We may remove or restrict content upon receiving valid complaints. We reserve final decision authority.

11. Administrative Control

We retain the right to moderate, edit, or restrict content, especially in cases of disputes or legal concerns.

12. Fees, Payments, and Refunds

  • Payments are non-refundable after service delivery;
  • Exceptions apply for technical errors or duplicate payments;
  • Refund decisions are at our discretion.

13. Duration of Memorial Pages

Memorial pages are hosted based on purchased plans. Upon expiry, pages may be removed or archived. We are not liable for content loss after expiration.

14. Intellectual Property

All platform content (excluding user content) is owned by MyLegacy Memorial Services and protected by law. Unauthorized use is prohibited.

15. Data Protection and Privacy (NDPR/GDPR Alignment)

We are committed to protecting personal data in accordance with the Nigeria Data Protection Act (NDPA/NDPR) and, where applicable, the General Data Protection Regulation (GDPR).

15.1 Roles

  • MyLegacy Memorial Services acts as a Data Controller for user accounts and platform operations.
  • For partner integrations, we may act as a Data Processor on behalf of funeral homes or clients.

15.2 Lawful Basis for Processing

We process personal data based on:

  • Consent;
  • Performance of a contract;
  • Legal obligations;
  • Legitimate interests (e.g., service improvement, fraud prevention).

15.3 Types of Data Collected

  • Personal identification data (name, email, phone number);
  • Memorial-related content (biographies, images);
  • Transaction and payment data;
  • Technical data (IP address, device info).

15.4 User Rights

Subject to applicable law, you have the right to:

  • Access your data;
  • Request correction or deletion;
  • Withdraw consent;
  • Object to processing;
  • Request data portability.

16. Business-to-Business (Funeral Home Partner) Terms

These provisions apply to funeral homes, agencies, or organizations ("Partners") using our Services.

16.1 Separation of Responsibilities

For clarity and risk allocation:

  • MyLegacy Memorial Services provides the technology platform and acts solely as a facilitator of digital memorial services;
  • Partners (Funeral Homes/Agencies) are responsible for client engagement, content submission, and obtaining all necessary consents and approvals;
  • Families / End Users are responsible for the accuracy, legality, and appropriateness of submitted content.

MyLegacy Memorial Services does not act as a party to funeral arrangements or memorial decisions and shall not be liable for disputes between Partners and families or among family members.

16.2 No Agency or Partnership

Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between MyLegacy Memorial Services and any Partner or user.

Partners operate as independent contractors and have no authority to:

  • Bind or represent MyLegacy Memorial Services;
  • Enter into agreements on behalf of MyLegacy Memorial Services;
  • Make warranties or guarantees regarding the Services.

MyLegacy Memorial Services is not responsible for the acts, omissions, or representations of any Partner.

16.3 Partner Role

Partners may use the platform to create and manage memorial content for clients.

16.4 Data Responsibility

  • Partners act as independent Data Controllers for client-submitted information;
  • MyLegacy Memorial Services acts as a Data Processor where applicable;
  • Partners must obtain lawful consent before submitting personal data.

16.5 Compliance

Partners agree to comply with:

  • NDPR/NDPA and applicable data protection laws;
  • All applicable consumer protection and advertising laws.

16.6 Content Responsibility

Partners are solely responsible for:

  • Accuracy of submitted memorial content;
  • Obtaining next-of-kin authorization;
  • Resolving disputes with clients.

16.7 Commercial Terms

  • Revenue sharing, commissions, or service fees may apply;
  • Additional commercial terms may be governed by separate agreements.

16.8 Suspension

We reserve the right to suspend or terminate Partner access for:

  • Legal violations;
  • Repeated disputes;
  • Misuse of the platform.

17. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind. We disclaim all warranties including:

  • Accuracy
  • Reliability
  • Availability
  • Fitness for a particular purpose

We do not guarantee uninterrupted or error-free operation.

18. Limitation of Liability

To the fullest extent permitted by law:

  • We shall not be liable for indirect, incidental, or consequential damages;
  • Our total liability shall not exceed the amount paid by you for the Service or ₦100,000 (whichever is lower).

19. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your use of the Services;
  • Your content;
  • Violation of these Terms.

20. Termination

We may suspend or terminate your access at any time for violations.

21. Arbitration and Dispute Resolution

Any dispute arising from these Terms shall be resolved through binding arbitration in Nigeria.

  • Arbitration shall be conducted in accordance with the Arbitration and Mediation Act, 2023;
  • The seat of arbitration shall be Lagos State;
  • Proceedings shall be conducted by a single arbitrator;
  • Parties waive the right to class actions or group litigation.

Nothing prevents either party from seeking urgent injunctive relief in a court of competent jurisdiction.

22. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.

23. Amendments

We may update these Terms at any time. Continued use constitutes acceptance.

24. General Provisions

  • Entire Agreement: These Terms constitute the full agreement;
  • Severability: Invalid provisions do not affect others;
  • No Waiver: Failure to enforce is not a waiver;
  • Force Majeure: We are not liable for events beyond our control.
